1. Agreement to These Terms

These Terms of Service ("Terms") form a binding legal agreement between you ("you," "User," or "Member") and Ali Razavi, an individual operating under the trade name AuraShots ("AuraShots," "we," "us," or "our"), the operator of the website located at aurashots.ai and any related mobile experiences (collectively, the "Service").

By creating an account, uploading a photo, subscribing to a paid plan, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to create an account or use the Service. AuraShots does not knowingly permit anyone under 18 to register, upload photos, or generate content. This age floor exists specifically because the Service processes photographs of real human faces to generate new imagery — a category of activity we treat as categorically inappropriate for minors regardless of the images' content, and one that meaningfully increases legal exposure under biometric and child-safety laws if minors are involved as either the uploader or the subject of an uploaded photo.

By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this agreement.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at aurashotsai@outlook.com if you suspect unauthorized access. We are not liable for any loss arising from your failure to safeguard your account credentials.

4. The Service

AuraShots allows subscribers to upload reference photographs of themselves and receive AI-generated images across a set of curated style categories (currently: Aura, Dating Apps, Humor & Memes, Social & Everyday, and Professional). Generated images are produced using third-party generative AI models (see Section 10, Third-Party Services) based on the reference photos and prompts you or we select.

AI output is inherently unpredictable. Generated images are approximations produced by machine-learning systems and may not accurately, fairly, or completely reflect your appearance, may contain visual artifacts or errors, and are not a guarantee of any particular result. You acknowledge and accept this uncertainty as an inherent characteristic of the Service, not a defect.

5. Subscriptions, Credits, and Billing

5.1 Subscriptions. AuraShots offers paid subscription plans billed on a monthly or annual basis. By subscribing, you authorize us, through our third-party payment processor, to charge the applicable fee to your payment method on a recurring basis until you cancel.

5.2 Money-Back Guarantee. New subscribers are eligible for a full refund of their initial subscription fee, provided that a refund request is made within fourteen (14) days of the initial purchase and no more than eight (8) total image credits have been used on the account, inclusive of any free trial credits used prior to subscribing. Eligibility ends when either limit is reached — fourteen (14) days from the date of purchase, or eight (8) cumulative credits used across the account — whichever occurs first.

5.3 Exclusions. The money-back guarantee applies only to a customer's initial subscription purchase. It does not apply to subscription renewals, to any purchase made after the guarantee period has ended, or once more than eight (8) image credits have been used on the account. Payment processing fees charged by our payment processor may be non-refundable and may be deducted from any refund issued.

5.4 How to Request a Refund. To request a refund, contact us at aurashotsai@outlook.com from the email address associated with your account, within the eligibility window described in Section 5.2. Approved refunds are issued to the original payment method within 5–10 business days.

5.5 Auto-Renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled before the renewal date.

5.6 Cancellation. You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will not renew and you will not be charged again; you will retain access to paid features until the end of your current billing period. Cancellation does not, by itself, entitle you to a refund. Except as expressly provided in Section 5.2, fees already paid are non-refundable, including for annual subscriptions cancelled partway through their term.

5.7 Credits. Image credits included with a subscription are provided for use during the applicable billing period only. Unused credits do not roll over and are forfeited at the end of each billing period. Credits have no cash value and are not redeemable for cash except as part of a refund issued under Section 5.2.

5.8 Changes to Pricing. We reserve the right to modify our pricing and plan offerings. Any change to subscription pricing will not take effect until your next renewal.

5.9 Free Trial and Promotional Credits. New accounts may receive a limited number of free credits and, for active subscribers, may be eligible for additional one-time promotional image sets ("gifts"). Gifts are a subscriber benefit, are granted at most once per gift category per account regardless of how many times your subscription renews, and have no cash value.

6. Your Content — Uploads, Ownership, and the License You Grant Us

6.1 What You Retain. As between you and AuraShots, you retain all ownership rights you already hold in the reference photographs you upload ("Reference Content").

6.2 License You Grant Us. By uploading Reference Content, you grant AuraShots a worldwide, non-exclusive, royalty-free, sublicensable (solely to our service providers described in Section 10, for the sole purpose of operating the Service) license to host, store, reproduce, and process that Reference Content strictly for the purpose of generating images you request and operating the Service (including credit accounting, customer support, and fraud prevention). This license ends when you delete the Reference Content or close your account, except for residual copies retained briefly in backups or as required by law.

6.3 Generated Images. As between you and AuraShots, you own the images generated from your own Reference Content ("Generated Content"), subject to (a) the underlying rights of any third-party AI provider in the model itself (not the output), and (b) our own right to use anonymized or aggregated data derived from the Service's operation (never your specific uploaded photos or generated images) to improve and maintain the Service.

6.4 Your Representations About Uploaded Photos. This is the most important promise you make to us. By uploading any photograph, you represent and warrant that:

  • (a) the photograph depicts you, or you have obtained the explicit, informed consent of every other identifiable person depicted to upload their likeness and have it processed by AI to generate new imagery;

  • (b) you have the legal right to upload the photograph (you own it, or are licensed to use it, and are not infringing anyone's copyright, privacy, or publicity rights by uploading it);

  • (c) the photograph does not depict any person under the age of 18;

  • (d) you will not use the Service to create content that is defamatory, harassing, non-consensually intimate or sexual, or intended to deceive, impersonate, or harm any real person; and

  • (e) you will not represent AI-generated output as an authentic, unaltered photograph in a context where that distinction materially matters (e.g., identity verification, dating profiles presented as candid photos where required by the platform's own rules, journalism, or legal proceedings).

6.5 Consequences of Breach. Uploading a photo of someone else without their consent, or of a minor, is a direct violation of these Terms and may expose you to legal liability independent of any action we take. We reserve the right to immediately suspend or terminate accounts that violate this section, remove the associated content, and report the conduct to law enforcement where we reasonably believe illegal activity (including depicting minors) has occurred. See Section 14 (Indemnification) for how liability from a breach of this section is allocated between you and us.

6.6 Biometric Data Notice and Consent. AuraShots does not extract, store, or use a separate biometric identifier or facial geometry template from your reference photographs. Your reference photos are transmitted directly to our third-party AI provider as generation input and are not otherwise analyzed for identification or verification purposes. To the extent any jurisdiction's law treats this processing as involving biometric information, you provide express written consent, by uploading a reference photograph, to our collection and use of that information solely to generate the images you request, for as long as your account or the uploaded photo remains active, and you acknowledge that this information is never sold, leased, or traded.

7. AI-Generated and Synthetic Content Disclosure

Every image produced through AuraShots is artificially generated using AI and does not depict a real, unaltered photograph, even where it closely resembles your uploaded reference photos. Where required by applicable law, including Article 50 of the EU AI Act, AuraShots takes reasonable steps to disclose the artificial nature of generated content, including embedding metadata identifying an image as AI-generated. Separately and in addition, you are responsible for disclosing the synthetic nature of any generated content you share, to any third party or platform where required by that platform's rules or by applicable law.

8. Sharing Features

AuraShots allows you to generate a shareable public link for an individual image you choose to share. Anyone with that link can view the image; it is not indexed or searchable through the Service itself, but you should treat any link you generate as effectively public once shared. You are solely responsible for your decision to share any image and for complying with Section 6.4 above with respect to any content you share.

9. Prohibited Uses

In addition to the restrictions in Section 6.4, you agree not to:

  • use the Service to create sexually explicit content involving any real, identifiable person without that person's explicit consent, or any content depicting a minor in any sexualized manner;

  • use the Service for impersonation, fraud, or to create content intended to deceive a specific individual or the public;

  • circumvent, disable, or interfere with credit limits, security features, or rate limits;

  • use automated means (bots, scrapers) to access the Service outside of the interfaces we provide;

  • reverse-engineer, decompile, or attempt to extract the underlying AI models or source code;

  • resell, sublicense, or provide commercial access to the Service to third parties without our written consent; or

  • use the Service in any way that violates applicable law, including export control, sanctions, or child-safety laws.

We may investigate and take appropriate action against anyone who violates this section, including suspending or terminating accounts, removing content, and cooperating with law enforcement.

10. Third-Party Services

The Service relies on third-party providers to function, including but not limited to: Google (Gemini API and Google Cloud Storage, for AI image generation and hosting), and Wix (site hosting, member accounts, and payment processing). Your Reference Content and Generated Content are transmitted to and processed by these providers as necessary to operate the Service. Their own terms and privacy practices govern their handling of that data in addition to ours; see our Privacy Policy for details on these transfers.

11. Intellectual Property

The Service itself — including its software, design, curated prompt libraries, trademarks, and branding — is owned by AuraShots or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right to use AuraShots' trademarks, prompt libraries, or underlying software outside of your permitted use of the Service.

Copyright complaints: If you believe content accessible through the Service infringes your copyright, contact our designated agent at aurashotsai@outlook.com with (a) identification of the copyrighted work, (b) identification of the allegedly infringing material and its location, (c) your contact information, and (d) a statement of good-faith belief and accuracy under penalty of perjury. We will respond in accordance with applicable copyright law, including the U.S. DMCA notice-and-takedown framework where applicable to content accessible to U.S. users.

12. Disclaimers

THE SERVICE AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE PROHIBITED BY APPLICABLE LAW. WE DO NOT WARRANT THAT GENERATED IMAGES WILL MEET YOUR EXPECTATIONS, BE ERROR-FREE, OR BE SUITABLE FOR ANY PARTICULAR USE (INCLUDING DATING PROFILES, PROFESSIONAL PROFILES, OR ANY CONTEXT WHERE ACCURACY OF LIKENESS MATTERS).

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AURASHOTS AND ANYONE ACTING ON OUR BEHALF, INCLUDING OUR SERVICE PROVIDERS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) CAD $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you, particularly with respect to statutory consumer-protection rights that cannot be waived by contract (this is notably true in Ontario and Quebec).

14. Indemnification

You agree to defend, indemnify, and hold harmless AuraShots and anyone acting on our behalf from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms, particularly Section 6.4 (Your Representations About Uploaded Photos); (b) your Content, including any claim that a photograph you uploaded was used without the depicted person's consent; or (c) your violation of any law or the rights of any third party.

15. Termination

You may stop using the Service at any time by canceling your subscription (Section 5.6) or simply discontinuing use. To request deletion of your account and associated data, contact us at aurashotsai@outlook.com. If you cancel your subscription without requesting account deletion, your account and content remain accessible to you and are retained so that you may resume the Service later; see our Privacy Policy (Section 8) for details. We may suspend or terminate your access if you violate these Terms, if required by law, or at our discretion with reasonable notice where practicable. Sections 6.4, 11, 12, 13, 14, and 17 survive termination.

16. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new "Last Updated" date and, for material changes, provide additional notice (such as an on-site banner or email). Continued use of the Service after changes take effect constitutes acceptance.

17. Governing Law and Disputes

17.1 Governing Law. These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

17.2 Dispute Resolution. Before filing any formal claim, you agree to first contact us at aurashotsai@outlook.com and attempt in good faith to resolve the dispute informally for at least 30 days.

18. General

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and AuraShots regarding the Service. Assignment. We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign these Terms without our consent. Contact.
